Under Florida law, any person may bring a civil action against an insurer when such person is damaged by the insurer’s failure to attempt "in good faith to settle claims when, under all circumstances, it could and should have done so, had it acted fairly and honestly toward its insured and with due regard for his interest."
We represent insured individuals who have suffered a serious loss and have been treated unfairly by their insurance company. Our experienced bad faith team assists our clients in assessing and evaluating every potential type of bad faith claim, including common law and statutory claims, and first and third party claims. We also have extensive experience in consulting, guiding, defending and pursuing all types of clients in potential or actual bad faith.
Sometimes the insurance company has denied the claim; sometimes they have provided an unfair settlement of a claim. What we have found over the years is that insurance coverage issues commonly arise following an accident, windstorm, or other event.
If your insurance claim has been denied or the insurance payment is unreasonably delayed, we can help you to identify the applicable coverage and resolve any legal issues that may exist. Our team will work with our clients throughout all stages of a potential or actual bad faith claim to ensure their unique needs are met.
